This Privacy Policy describes how PepperSend, a product of Hexoglyph Holdings, LLC ("PepperSend," "Company," "we," "us," or "our") collects, uses, processes, stores, and discloses information in connection with its AI-powered missed-call response, conversational SMS, and business communication services (the "Service").
By accessing or using the Service, you acknowledge that you have read, understood, and agree to the terms outlined in this Privacy Policy.
"Service" refers to the PepperSend platform, its AI-driven conversational SMS capabilities, missed-call auto-response workflows, appointment scheduling, VoIP call handling, and any associated web-based interfaces operated by PepperSend.
"User Data" means any information that identifies or can reasonably be linked to an individual, including mobile phone numbers, names, email addresses, and business identifiers.
"Message Content" refers to the text and metadata of communications sent to or from the Service, including timestamps, delivery status, sentiment indicators, and AI-generated responses.
"Subprocessor" refers to third-party entities engaged by PepperSend to process data on its behalf for SMS delivery, VoIP services, cloud infrastructure, AI processing, or automated logic.
SMS Data Privacy: No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Opt-In: Consent to receive SMS messages is obtained via one of the following methods: (a) express written action on web forms or landing pages that clearly disclose SMS communication, (b) the End Recipient initiating a mobile conversation with a phone number designated by the Service, or (c) a missed call to a PepperSend-enabled business number, where the caller has been informed that an automated SMS response will follow.
Opt-Out: End Recipients may cancel at any time by replying "STOP." A confirmation message will be sent, after which no further messages will be delivered unless consent is re-established.
Assistance: Reply "HELP" for additional support information.
Rates and Frequency: Message and data rates may apply. Message frequency varies based on user interaction and conversational workflows. Participation is not a condition of purchase.
PepperSend collects only the minimum data necessary to operate the Service. This includes account identifiers, phone numbers, interaction metadata, Message Content required for conversational AI processing, call records (including missed-call timestamps and caller ID), and business profile information provided during onboarding.
The Service uses artificial intelligence and automated logic to interpret Message Content, generate conversational responses, detect caller intent and sentiment, schedule appointments, and manage handoff to human operators when appropriate.
Automated systems may produce inaccurate, incomplete, or unintended results. Users and End Recipients are responsible for confirming critical details, including appointment times, service availability, and pricing, independently of AI-generated responses.
PepperSend disclaims liability for errors resulting from automated processing, sentiment misclassification, or intent misinterpretation.
The Service integrates with VoIP and telephony providers (including but not limited to RingCentral and Intermedia) to facilitate call handling and SMS delivery. Call metadata, such as caller ID, call duration, timestamps, and voicemail transcriptions, may be collected and processed to trigger automated workflows.
VoIP provider data is handled in accordance with each provider's terms of service and data processing agreements. PepperSend does not record call audio unless explicitly configured and disclosed by the User.
PepperSend acts as a data processor when transmitting messages and handling calls on behalf of Users, and as a data controller for information collected directly through Company-operated interfaces and support channels.
User Data is shared with Subprocessors only as necessary to deliver the Service, including telecommunications carriers, VoIP providers, cloud infrastructure providers, AI model providers, and payment processors. User Data is never sold.
PepperSend implements industry-standard safeguards, including encryption in transit and at rest. Data is retained only as long as necessary to fulfill conversational workflows, service delivery, and account management, unless longer retention is required by law or legitimate business purposes.
In the event of a data breach involving your personal information, PepperSend will notify affected Users without undue delay and in accordance with applicable law. Where required, PepperSend will notify relevant regulatory authorities within 72 hours of becoming aware of the breach. Notification will describe the nature of the breach, the categories of data affected, likely consequences, and measures taken or proposed.
Depending on jurisdiction, individuals may request access, correction, or deletion of their data by contacting PepperSend through the support portal or by emailing the address listed in Section 13 below.

This Privacy Policy is governed by the laws of the State of Utah, without regard to conflict-of-law principles.
